“Negotiable Instruments”

CASE 01:
Mr. Umar has taken a loan of Rs. 50,000 from his friend Mr. Akbar. Umar has made a document
stating that he will pay the money to Akbar or the bearer on demand or payment will be made after
three months. This document, once signed by Umar, duly stamped and handed over to Akbar, becomes
a negotiable instrument. Now Akbar can personally present it before Umar for payment or give this
document to some other person to collect money on his behalf. He can further endorse it in somebody
else’s name till the final payment is made by Umar.
1. Identify the type of document used in the above case? Provide reasons to justify your answer.
2. Identify and name of the parties involved in this document?

CASE 02:
Suppose Usman has given a loan of Rs. 20,000 to Sharafat, which Sharafat has to return to Usman.
Now, Usman also has to give some money to Shaharyar. In this case, Usman can make a document,
directing Sharafat to make payment up to Rs. 20,000 to Shaharyar on demand or after expiry of a
specified period (four month).
1. Identify the type of document used in the above case? Provide reasons to justify your answer.
2. Identify and name of the parties involved in this document?

Mere khayal se promissory note ha.


Is ma shayad Usman, Akbar or Bearer parties involved hain.

Case #2

Q1. Ya quasi type contract ha or conditional ha. Documents kis type ke ho skte hain ya nhi janta ma..

Q2. Usman, Sharafat or Shaharyar..

I think in second case document is bill of exchange because bill of exchange can be conditionally and name of parties can be Usman is drawer and Sharafat is drawee but what can be name of shaharyar?

I think the first case is of bill of exchange and second case is promissory note.

Because the first case is transferring further, and in second case usman is making a note of promise.

In first case Akbar and umar both are involved and in second case, usman, sharafat, and shahryar all are involved.

What you all think about it?????

but second case is conditionally and promissory note can never be conditionally....

i knew that i m right...
