Scenario

Mr. Abdullah made a contract to buy a house from Mr. Ayan. He pays half of the amount as per the contract and promises to take over the house after three months by paying the remaining amount. During this period heavy flood and earthquake destroy a portion of the house and Mr. Ayan is not ina position (capable) to repair the house for Mr. Abdullah. But Mr. Abdullah refuses to take the house due to damages occurred by the flood.

Discussion Question:

a)    How the law treats the above scenario?

b)    As per the above scenario, who will be responsible to bear this loss and why?

Discuss with solid and logical arguments.

It seems that the law will tell to the Mr. Abdullah that fix the house first and then the condition of the contact will fulfill otherwise the contract will be void and Mr. Abdullah should return the money of Mr. Ayan.

Mr. Abdullah bear the loss beacuse possesson is not transfered to MR. ayan
