What kind of relationship was defined by the First Constituent Assembly of Pakistan between state and Islam? Justify your answer with five relevant points.

Answer:

The Constituent Assembly (1947-54)
1. The state shall exercise its power through the representatives of the people.
2. The authority which He has delegated to the state of Pakistan through its people for being exercised within the limits prescribed by Him is a sacred trust.
3. Minorities to have freedom to freely profess and practice their religions and develop their cultures.
4. The interim report of Basic Principles Committee was presented to the constituent assembly.
5. Objectives Resolution passed by the Constituent Assembly on aims and objective of future constitution.


Question No. 2
Why did the First BPC Report (1950) fail to satisfy the people of both wings of Pakistan? Justify
your answer with five relevant points.

Answer:
● This committee presented its first report on 1950 but was severely criticized, particularly in East Pakistan so it referred back to the Constituent Assembly. On 28th September 1950 the BPC presented its interim report to the Constituent Assembly. The salient features of this report were as following:
● Objectives Resolution should be made part of the constitution and should serve as the directive principle of state policy.
● According to this report two houses of the parliament were proposed. The lower house was to be elected on the basis of populations and the upper house was to be elected on the basis of equal representation for all the provinces of Pakistan.
● Federal legislature had the authority to remove the head of state.
● In case of a dispute, the Supreme Court had the authority to interpret the constitution.
● The procedure to amend the constitution was very rigid; it required a majority approval from the central and provincial legislatures.
